Terms of Service

Last updated: 3 November 2026

1. About these terms

These terms apply when you use Martyn's Law Procedures (the "Service"). By creating an account or using the Service, you agree to them. "We", "us" and "our" mean Dutywise Ltd, trading as Martyn's Law Procedures. "You" means the organisation using the Service, and the person who accepts these terms confirms they can do so for it. Our Privacy policy explains how we handle personal information.

2. Who we are

Dutywise Ltd, a private limited company registered in England and Wales, company number 17498786. Registered office: 8 Cornfield Close, Chandler's Ford, Eastleigh, SO53 4HD. Email: help@martynslawprocedures.co.uk.

3. The Service

3.1 Martyn's Law Procedures helps the people responsible for premises in the UK prepare public protection procedures and keep records for the standard tier of the Terrorism (Protection of Premises) Act 2025. It fills in standard wording with the details you enter.

3.2 The Service is a tool to help you. It does not notify the Security Industry Authority for you, assess whether your premises are in scope or which tier applies, or decide whether your procedures are appropriate. It doesn't give legal or professional advice, or make you compliant with any law. You remain responsible for meeting your legal duties.

3.3 The Service is designed for the United Kingdom. It is for business use, not for consumers, and you must be 18 or over to use it.

3.4 We keep our wording under review, but the law and guidance can change, and we don't promise the wording suits every situation.

4. Your account

Give us accurate information and keep it up to date. Keep your log-in details secure and tell us straight away if you think someone else has used your account. You're responsible for everything done through your account, including by anyone you invite.

5. Paying for the Service

5.1 Some features are free. Others need a paid subscription. Prices are shown on our website before you pay, in pounds sterling.

5.2 Payments are taken by our secure payment provider. We don't see or store your full card details.

5.3 Subscriptions renew automatically until you cancel. You can cancel at any time. Cancelling takes effect at the end of the period you've paid for, and you keep access until then.

5.4 We'll email you at least 30 days before a price change applies to you.

5.5 If we can't take a payment within 14 days of it failing, we may suspend paid features until you pay.

5.6 £5 of each pack fee is donated to charity as described on our Charity page. This does not change the price you pay or your rights.

6. Your responsibilities

You're responsible for the accuracy of what you enter, for checking every document before you use it, for getting professional advice where you need it, for keeping your own copies of what you need, and for meeting your legal duties. Due dates and reminders are there to help you, and you must not rely on them as your only way of keeping track.

7. Acceptable use

You must not use the Service to break the law or mislead anyone; enter information you don't have the right to use; enter information about anyone's health, disability, vulnerability or criminal offences; try to get into our systems without permission or interfere with how the Service works; or resell the Service or copy it to build a competing product. You may share the documents it produces with the people they're meant for.

8. Ownership

You own the information you enter. We own the Service, its design and our standard wording. While you have an account, you may use the Service, and copy, print and share the documents it produces, for your premises. We use your information only to provide, secure and improve the Service and to meet our legal duties.

9. Personal information you enter

When you enter personal information about other people, you are the controller of it and we process it for you as your processor. We will: use it only to provide the Service, following your instructions; keep it confidential and secure; only use trusted sub-processors who are bound by equivalent terms, and tell you before we add or replace one so you can object; help you deal with requests from people about their data, and with security, breaches and impact assessments; tell you without undue delay, and within 48 hours, about any breach affecting it; delete it when your account closes, unless the law requires us to keep it; and give you the information you reasonably need to show we meet these terms. We won't transfer it outside the UK without the safeguards UK data protection law requires.

10. Availability and support

We aim to keep the Service available and working, but we don't promise it will always be available or free of errors. We may change or improve features. For help, email help@martynslawprocedures.co.uk. We aim to reply within 2 working days.

11. Our liability

11.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.

11.2 Otherwise, we are not liable for loss of profit, business or data, for indirect loss, for any fine or enforcement action against you, or for loss caused by information you entered or documents you didn't check.

11.3 Our total liability to you is limited to the greater of the fees you paid us in the 12 months before the claim and £100.

12. Closing your account

You can close your account at any time. We may suspend or close it if you seriously break these terms or don't pay, or for any other reason with 30 days' notice. Download anything you want to keep before your account closes. We delete your content within 90 days of closure, except anything the law requires us to keep.

13. General

We may update these terms, and we'll email you at least 30 days before a change that materially affects you. If part of these terms can't be enforced, the rest still applies. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
